DECISION

Stipulating functions, duties, authorities, responsibility and working mode of the Division of General Administration

PRESIDENT OF INSTITUTE FOR STATE ORGANIZATIONAL SCIENCES

Pursuant to the Decree No.61/2012/CP dated 10 August 2012 by the Government stipulating functions, duties, authorities and organizational structure of the Ministry of Home Affairs;

Pursuant to the Decision No.749/QD-BNV dated 17 June 2013 by the Minister of the Ministry of Home Affairs stipulating functions, duties, authorities and organizational structure of the Institute for State Organizational Sciences;

At the proposal of the Head of the Division of General Administration,

DECIDES:

Article 1. Position, functions

Division of General Administration is a unit of the Institute for State Organizational Sciences under the Ministry of Home Affairs (hereafter briefly called the Institute); performing consultative function to assist the President to manage organization – personnel, administration – governance and international cooperation of the Institute; conduct studies on the fields in state management jurisdiction of the Ministry of Home Affairs under the assignment of the President.

Article 2. Duties

1. Assist the President to manage the Institute’s administration - governance:

a) Consolidate, build and follow up implementations of periodic reports (weekly, monthly, semi-annual and annual reports), thematic reports and unscheduled reports of the Institute to send to the Ministry’s Leaders and relating units;

b) Organize management of records and archives; process incoming and out-going documents and manage the use of the seal of the Institute in accordance with legal regulations;

c) Chair or cooperate with the Institute’s subordinate units to hold meetings, workshops, conferences and evaluation of projects, proposals, scientific research programs as assigned by the President;

d) Ensure means of transport for field trips and working facilities for civil servants and public employees in the Institute;

dd) Purchase, manage the distribution, assigning and usage of assets against prescribed regimes, standards and spending norms. Submit the President to report to authority levels to issue the decisions of withdraws, adjusting, liquidation of assets in the jurisdiction of the Institute;

e) Provide instructions to units, individuals for correctly performance of the regime of registration, distribution, usage, listing and reporting of assets in the jurisdiction of the Institute;

g) Examine the Institute’s asset management and usage in accordance with current stipulations;

h) Coordinate with the Division of Planning – Finance to perform statistics in accordance with the Institute’s regulations;

i) Be the focal point in resolving problems concerning the Institute’s asset management and usage.

2. Assist the President to manage organization – personnel of the Institute including:

a) Recruitment and signing labouring contracts, allocating, utilizing and managing public employees;

b) Appointment, dismissal, introduction, circulation, rewarding, disciplines of public employees and management of public employees’ profiles;

c) Perform regimes of learning, training, fostering and applying regimes of remuneration and other regimes for civil servant, public employees and labourers of the Institute;

d)  Perform medical insurance, social insurance for civil servant, public employees and labourers of the Institute as regulated by law;

dd) Pursuant to requirements and duties assigned by the Ministry’s Leader in each period to conduct review and studies to propose of separation, merging or new establishment of subordinate units in the Institute;

e) Assist the President to build and supervise the implementation of the Institute’s Working Regulations.

3. Assist the President to carry out international cooperation activities:

a) Be the focal point assisting the President to manage international cooperation activities on scientific studies and training, fostering in with foreign countries;

b) Submit the President guiding principles and plans to expand relationship with foreign countries and international organizations in scientific studies;

c)  Cooperate with the Division of Planning – Finance to develop and submit to the President for issuing international cooperation programs and plan for five-year term, annually and unscheduled, urgent international cooperation missions in the jurisdiction of the Institute.

d) About international agreements development and implementation:

- Cooperate with relating units to develop international partnership agreements on scientific studies in the jurisdiction of the Institute;

- Arrange the implementation or recommend organizing implementation, management and supervision of international cooperation activities in the jurisdiction of the Institute;

- Submit the President to sign and carry out partnership agreements on behalf of the Institute with international organizations, agencies on scientific studies in the jurisdiction of the Institute.

dd) Organize out-going delegation to foreign countries and receive in-coming delegations from other countries to work with the Institute:

- Chair, cooperate with relating units to submit to the President annual plan of out-going delegations to foreign countries and receive in-coming delegations from other countries to work with the Institute (briefly called out-going delegations and in-coming delegations);

- Cooperate with organizations and units to receive and work with international delegations coming to the Institute.

e) Chair, cooperate with relating organizations and units to develop international cooperation programs, proposals, projects, which are chaired by the Institute; chair the evaluation sessions of international partnership programs, proposal and projects developed by the Institute’s subordinate divisions and centres; recommend implementation arrangements for the approved programs, proposals and projects;

g) Chair, cooperate with relating agencies and units to organize international conferences for scientific studies on the fields in the state management jurisdiction of Ministry of Home Affairs in Vietnam;

h) Cooperate with relating units to conduct training and fostering the Institute’s public employees under the framework of foreign-funded programs, schemes, projects.

4. Chair, participate in researching activities, performing schemes, projects, implementing statutory documents, programs, scientific topics and provide feedbacks, participate in appraisals of schemes, projects, prepare the draft of documents under the functions, duties of the Division as assigned by the President.

5. Participate in implementation of public services as assigned by the President.

6. Manage public employees, equipment, working facilities of the Division provided by the Institute as regulated;

7. Perform the information and reporting and statistical mode in accordance with the Working Regulations of the Institute.

8. Perform other duties assigned by the President.

Article 3. Authorities and responsibilities

1. Authorities:

a) Division of General Administration is provided with documents, documentaries, data, information, expenses, means and facilities necessarily to perform its functions and duties; actively organizes its work to fulfil functions and duties that are assigned; actively solve the Division’s work to accomplish the functions and duties assigned;

b) The Head of the Division of General Administration has the power to request the Institute’s subordinate divisions and centres to report on their allocation, assignment and utilization of public employees and their status of using equipment, facilities, assets and other issues related to serve consultative function to assist the President.

c) Public employees in the Division have the following rights:

- Participate in semi-annual reviews, annual reviews of the Institute, and the organization of the Ministry (if included in the participation component in the written invitation), workshops, scientific conferences, evaluation of scientific topics, projects, scientific research programs held by the Institute;

- Participate in the Council of appraisal, evaluation and taken over scientific studies, scientific topics as assigned by the Leader of the Institute or the Head of the Division; participate in scientific meetings of the Institute;

- Participate in teaching, training on professional fields under the functions and duties of the Ministry, of the Institute in accordance with the working regulation of the Institute;

- Participate in delegation in surveying mission, learning, upgrading professional level, foreign languages and computing skills inside the country and abroad as work requested and as assigned by the President; to be permitted to exploit information, data, database and scientific research outcomes as stipulated in the working regulation of the Institute.

2. Responsibilities:

a) Head of the Division of General Administration manages and administers the Division’s work, organizes to effectively implement working plan of the Division, being accounted to the President about the whole work of the Division;

b) Public employees of the Division of General Administration are responsible for good and fully performance of functions and duties assigned, closely cooperate with other units to implement general functions and duties of the Institute; comply with internal regulations, stipulations and Working Regulations of the Ministry and the Institute.

Article 4. Organization and working mode

1. The Division of General Administration comprises of Head, Deputy Head and public employees.

2. Working mode: The Division of General Administration is organized and operates under the leader-central mode.

a) Head of the Division manage and administer the general work of the Division in accordance with the functions, duties assigned and other unscheduled work as assigned by the President;

b) Deputy Head of the Division assists the Head to take charge of the Division’s work, which are delegated by the Head, and be accounted to the Head for the delegated work; stay on behalf of the Head to manage, administer the work of the Division in case that the Head is absence;

c) Public employees of the Division of Organizational Sciences organize to implement duties in accordance with the assignment of the Head. As required at work, public employees may directly work with and perform the duties assigned by the President, and must report the assigned duties to the Head of the Division.

Article 5.  Implementation

1. This Decision takes its full effects since the date of signing.

2. This Decision replaces the Decision No. 18/QD-VKH dated 06 March 2009 by the President of the Institute for State Organizational Sciences on stipulating functions, duties, authorities, responsibilities and working mode of the Division of General Administration.

3. The Head of General Administration Division, Heads and public employees of the subordinate units of the Institute are responsible for implementing this Decision./.
