DECISION

Stipulating functions, duties, authorities, responsibility and working mode of the Division of Cadre and Civil Servant Management Studies

PRESIDENT OF

INSTITUTE FOR STATE ORGANIZATIONAL SCIENCES

Pursuant to the Decree No.61/2012/CP dated 10 August 2012 by the Government stipulating functions, duties, authorities and organizational structure of the Ministry of Home Affairs;

Pursuant to the Decision No.749/QD-BNV dated 17 June 2013 by the Minister of the Ministry of Home Affairs stipulating functions, duties, authorities and organizational structure of the Institute for State Organizational Sciences;

At the proposal of the Head of the Division of General Administration and the Head of the Division of Cadre and Civil Servant Management Studies,

DECIDES

Article 1. Position, functions

The Division of Cadre and Civil Servant Management is a unit of the Institute for State Organizational Sciences under the Ministry of Home Affairs; performing consultative function to assist the President to conduct and develop fundamental theoretical studies; research to develop strategy, policy regime; research to apply outcomes of scientific studies on civil service, cadre and civil servant regimes into working practices of Ministries, sectors and localities; performing the Institute’s public services.

Article 2. Duties

1. Conduct fundamental theoretical studies on management and development of the staff of cadres and civil servants:

a) Study on opinions, managerial and developmental principles for the staff of cadres and civil servants

b) Study on scientific basis for developing and perfecting the system of standards and titles of cadres and civil servants;

c) Study in scientific basis of building and perfecting regulations in recruitment, using, rank upgrading, appointment, rank transfer; evaluation, appointment, reappointment, maneuver, circulation, resignation, dismissal, dispatch; disciplinary sanctions, demission, retirement and other regimes and policies for cadres and civil servants;

d) Studies on opinions, principles and contents of management and decentralization in management of cadres, civil servants in state administrative organizations;

dd) Studies on rights and obligations of cadres, civil servants, public employees; communication culture and the ethics of cadres, civil servants, public employees in civil service and professional career activities..

2. Research to develop strategy, policy regime to serve the state management function of the Ministry:

a) Study on scientific basis for building and perfecting the system of institution, policy regimes on cadres, civil servants and civil service regime;

b) Research to establish schemes, projects, statutory documents on cadres, civil servants under the state management function of the Ministry as assigned by the President.

3. Study to apply scientific research outcomes in to working practices of the Institute, serving to meet requirements of the Ministry, sector and localities:

a) Study to apply scientific research outcomes of the evaluated schemes, programs and projects into the performance of the Institute’s duties, in response to working requirements of Ministries, sectors and localities;

b) Study on deployment of the authorized schemes, laws, and statutory documents on cadres, civil servants in realistic operation of the Institute, serving to meet requirements of the Ministry, sector and localities.

4. Chair, coordinate in implementation of studies on schemes, projects, programs and scientific research topics; participate in giving consultations, policy reviews in relating to cadre and civil servant management.

5. Conduct sociological surveys on organization and personnel issues; cooperate to organize scientific conferences for the purpose of research.

6. Participate in implementation of public services as assigned by the President.

7. Manage public employees, equipments, working facilities of the Division provided by the Institute as regulated.

8. Perform the information and reporting and statistical mode in accordance with the Working Regulations of the Institute.

9. Perform other duties assigned by the President.

Article 3. Authorities and responsibilities

1. Authorities:

a) The Division of Cadre and Civil Servant Management Studies is provided with documents, documentaries, data, information, expenses, means and facilities necessarily to perform its functions and duties; actively organizes its work to fulfill functions and duties that are assigned.

b) Public employees in the Division have the following rights:

- To participate in semi-annual reviews, annual reviews of the Institute, and the organization of the Ministry (if included in the participation component in the written invitation), workshops, scientific conferences, evaluation of scientific topics, projects, scientific research programs held by the Institute;

- To participate in the Council of appraisal, evaluation and taken over scientific work, scientific topics as assigned by the Leader of the Institute, or the Head of the Division; participate in scientific meetings of the Institute;

- To participate in teaching, training on professional fields under the functions and duties of the Ministry, of the Institute in accordance with the working regulation of the Institute;

- To participate in delegation in surveying mission, learning, upgrading professional level, foreign languages and computing skills in-country and abroad at work request and as assigned by the President; to be permitted to exploit information, data, database and scientific research outcomes as stipulated in the working regulation of the Institute.

2. Responsibilities:

a) Head of the Division of Cadre and Civil Servant Management Studies is responsible for setting up working programs and plans of the Division, managing and administering and organizing work of the Division, and be accounted to the President for the whole activities of the Division;

b) Public employees of the Division of Cadre and Civil Servant Management Studies is responsible for good and fully performance of functions and duties assigned, closely cooperate with other units to implement general functions and duties of the Institute; comply with internal regulations, stipulations and working regulations of the Ministry and the Institute.

Article 4. Organization and working mode

 1. The Division of Cadre and Civil Servant Management Studies comprises of: Head, Deputy Head and public employees.

2. Working mode: Division of Cadre and Civil Servant Management Studies operates under the leader-central mode:

a) Head of the Division manage and administer the general work of the Division in accordance with the functions, duties assigned and other unscheduled work as assigned by the President;

b) Deputy Head of the Division assists the Head to take charge of the Division’s work, which are delegated by the Head, and be accounted to the Head for the delegated work; stay on behalf of the Head to manage, administer the work of the Division in case that the Head is absent;

c) Public employees of the Division of Cadre and Civil Servant Management Studies organize to implement duties under the assignment of the Head. As required at work, public employees may directly work with and perform duties which are assigned by the President, and must report the assigned duties to the Head of the Division.

Article 5. Implementation

1. This Decision takes its full effects since the date of signing.

2. This Decision replaces the Decision No.17/QD-VKH dated 06 March 2009 by the President of the Institute for State Organizational Sciences on stipulating functions, duties, authorities, responsibilities and working mode of the Division of Organizational Sciences.

3. The Head of General Administration Division, Head of Division of Cadre and Civil Servant Management Studies Heads and public employees of the subordinate units of the Institute are responsible for implementing this Decision./.
