DECISION

Stipulating functions, duties, authorities, responsibility and working mode of the Division of Planning - Finance


PRESIDENT OF INSTITUTE FOR STATE ORGANIZATIONAL SCIENCES

Pursuant to the Decree No.61/2012/CP dated 10 August 2012 by the Government stipulating functions, duties, authorities and organizational structure of the Ministry of Home Affairs;

Pursuant to the Decision No.749/QD-BNV dated 17 June 2013 by the Minister of the Ministry of Home Affairs stipulating functions, duties, authorities and organizational structure of the Institute for State Organizational Sciences;

At the proposal of the Head of the Division of General Administration and the Head of Division of Planning - Finance,

DECIDES:

Article 1. Position, functions

Division of Planning - Finance is a unit of the Institute for State Organizational Sciences under the Ministry of Home Affairs (hereafter briefly called the Institute); performing consultative function to assist the President to manage planning, finance, accountancy and statistical activities of the Institute as regulated by law.

Article 2. Duties

1. Planning, finance and accountancy:

a) Chair, cooperate with the Institute’s subordinate divisions and centres and other external organizations and units in planning and making overall five year development plan, annual operational plan of the Institute for State Organizational Sciences to submit to the President and authority levels to approve;

b) Prepare annual financial plans;

c) Examine, supervise the implementation, by compared with the planned, performed by the Institute’s subordinate divisions and centres and other external organizations and units, which are currently using the financial budget controlled by the Institute; propose, where necessarily, to adjust the allocation and duties in accordance with the plan to ensure progress and realization of the plan;

d) Provide instructions and examine the implementation of management mechanism regarding finance, accounting, asset management and internal spending regime of the Institute against the Institute’s Regulation and statutory stipulations;

dd) Submit to the President to issue plans and management mechanism in finance, accounting and internal spending regime as decentralized by the Ministry of Home Affairs and statutory stipulations;

e) Provide instructions and examine the implementation of Institute’s subordinate divisions and centres and other external organizations and units against the regulations of the Ministry and the Institute of planning, financial management, accounting in using State budget for scientific studies; national and international proposals, projects organized and chaired by the Institute for State Organizational Sciences;

g) Participate in drafting documents chaired by the Institute’s subordinate divisions and centres to submit to the President or the Ministry’s Leader for consideration and determination;

h) Be the focal point to assist the President to solve issues regarding planning, finance, and accounting activities of the Institute for State Organizational Sciences.

2. Capital management and payments:

a) Provide instructions to organizations and units using scientific budget on building forecast on annual revenue and spending; appraising and consolidating the estimated revenues and spending in order to report to concerning professional agencies;

b) Pursuant to the estimated State revenues and expenditures allocated annually, develop budget allocation options for programs, projects and scientific research projects to report to the President and submit to the Ministry’s Scientific Council and authorized functional agencies for appraisal and approval;

c) Provide instructions and monitor the Institute’s subordinate divisions and centres and other external organizations and units to deploy the estimated state revenues and spending allocated against the contents of proposals, projects and research projects in particular;

d) Manage loans, sponsored funds and other financial sources relating to the Institute’s operation. Examine, monitor and evaluate efficiency in uses of the above-mentioned funds as regulated by law;

dd) Supervise and report to the President to submit to authorized levels the decision of temporary suspension or termination of funding and fund drawback for the organizations, units and individuals who failed to obey financial spending regulations in scientific activities;

e) Supervise, appraise and make payments of spending from the financial sources controlled by the Institute;

g) Consolidate and report to upper-line management bodies of financial management and accounting status in periodic base and unscheduled base; be the focal point in handling payments of the Institute’s budget;

h) Periodically prepare semi-annual (30 June) and annual (31 December) financial and accounting reports to submit to the Institute’s Leader of financial, accounting activities;

i) Submit to the President to sign contracts, supervise and monitor the implementation of contracts and contract liquidation regarding scientific studies and other contracts relating to the Institute’s working fields, excluding labouring contracts;

k) Provide instructions and cooperate with the Institute’s subordinate divisions and centres and other external organizations and units in evaluation of efficiency in use of state budget and other financial sources for scientific activities;

l) Build and monitor the use of budget for international cooperation activities, office management, research projects, projects, workshops, conferences and programs;

3. Asset management:

a) Cooperate with the Division of General Administration to develop plan and submit to the President for consideration and make requests to authorized level to approve the plans of purchase, replacements and major repairs of assets, facilities, equipments to serve the Institute’s operation in accordance with current regimes;

b) Organize, management and uses of assets in accordance with regimes, criteria and norms. Submit to the President to decide the internal circulation of and liquidations of assets as decentralized, in asset management and uses, by the Ministry of Home Affairs;

c) Conduct periodic inventory and report the asset management and uses status under the control of the Institute as regulated.

4. Statistical activities:

a) Be focal point in conducting inventory activities of the Institute. Perform reporting and statistical mode to submit to the Ministry of Home Affairs and state agencies as prescribed by law and support the Institute’s Leaders in management and administration;

b) Cooperate with the Centre for Information and Library to apply information technology into statistical activities. 

5. Other duties:

a) Manage public employees, equipment, working facilities of the Division provided by the Institute as regulated;

b) Cooperate to organize workshop, conferences, research projects, projects as assigned by the President;

c) Perform other duties assigned by the President.

Article 3. Authorities and responsibilities

1. Authorities:

a) Division of Planning – Finance is provided with documents, documentaries, data, information, expenses, means and facilities necessarily to perform its functions and duties; actively organizes its work to fulfil functions and duties that are assigned; actively solve the Division’s work to accomplish the functions and duties assigned;

b) The Head of the Division of Planning – Finance has the power to request the Institute’s subordinate divisions and centres to provide files and documents to examine and monitor the implementation of financial spending as regulated, provision of data to serve the Institute’s statistical activities as requested by state agencies and required by law. Participate in meetings, negotiation sessions and implementation of operational activities conducted by the Institute and by other subordinate divisions and centres in the Institute.

c) Public employees in the Division have the following rights:

- Participate in semi-annual reviews, annual reviews of the Institute, and the organization of the Ministry (if included in the participation component in the written invitation), workshops, scientific conferences, evaluation of scientific topics, projects, scientific research programs held by the Institute;

- Participate in building, giving feedbacks to research projects, projects and proposals as assigned by the President;

- Participate in researching programs, research projects, proposals and projects as assigned by the President;

- Participate in scientific meetings of the Institute;

- Participate in delegation in surveying mission, learning, upgrading professional level, foreign languages and computing skills inside the country and overseas as work requested and as assigned by the President; to be permitted to exploit information, data, database and scientific research outcomes as stipulated in the working regulation of the Institute.

2. Responsibilities:

a) Head of the Division of Planning – Finance manages and administers the Division’s work, organizes to effectively implement working plan of the Division, being accounted to the President about the whole work of the Division;

b) Public employees of the Division of Planning – Finance are responsible for good and fully performance of functions and duties assigned, closely cooperate with other units to implement general functions and duties of the Institute; comply with internal regulations, stipulations and Working Regulations of the Ministry and the Institute.

Article 4. Organization and working mode

1. The Division of Planning – Finance comprises of Head, Deputy Head and public employees.

2. Working mode: The Division of Planning – Finance is organized and operates under the leader-central mode.

a) Head of the Division manage and administer the general work of the Division in accordance with the functions, duties assigned and other unscheduled work as assigned by the President;

b) Deputy Head of the Division assists the Head to take charge of the Division’s work, which are delegated by the Head, and be accounted to the Head for the delegated work; stay on behalf of the Head to manage, administer the work of the Division in case that the Head is absence;

c) Public employees of the Division of Organizational Sciences organize to implement duties in accordance with the assignment of the Head. As required at work, public employees may directly work with and perform the duties assigned by the President, and must report the assigned duties to the Head of the Division.

Article 5. Implementation

1. This Decision takes its full effects since the date of signing.

2. This Decision replaces the Decision No. 19/QD-VKH dated 06 March 2009 by the President of the Institute for State Organizational Sciences on stipulating functions, duties, authorities, responsibilities and working mode of the Division of Planning - Finance.

3. The Head of General Administration Division, Head of Division of Planning - Finance; Heads and public employees of the subordinate units of the Institute are responsible for implementing this Decision./.
